NHS estates: where FM is clinical

Facilities management in an NHS hospital is not the same discipline as facilities management in a government office. The compliance environment is fundamentally different. The consequences of failure are fundamentally different. And the framework model that connects the two is often inadequate for the clinical estate.

The compliance stack

NHS Hard FM operates under a compliance framework that has no equivalent in other public sectors. Health Technical Memoranda (HTMs) govern the maintenance of critical engineering systems: HTM 01–01 for decontamination, HTM 02–01 for medical gas pipeline systems, HTM 03–01 for heating and ventilation, HTM 04–01 for water systems (including Legionella management under L8), HTM 05–01 for fire safety, and HTM 06–01 for electrical services.

Each HTM prescribes specific maintenance regimes, competency requirements, and documentation standards that go far beyond anything required in a standard FM contract.

Soft FM in NHS estates is equally specific. Patient Environment Action Team (PLACE) assessments measure the quality of cleaning, food, and the built environment from a patient perspective.

Infection Prevention and Control (IPC) standards dictate cleaning frequencies, product specifications, and waste segregation protocols. Clinical waste handling requires specialist training, licensed carriers, and auditable disposal chains.

Catering operates under nutritional standards set by NHS England, with allergen management, therapeutic diets, and halal/kosher provision adding complexity that a generic cleaning and catering framework does not contemplate.

The ERIC Reckoning series examined how NHS Estates Return Information Collection (ERIC) data drives capital allocation and procurement decisions across the NHS estate. The data quality limitations identified in that series directly affect the specifications that NHS FM framework call offs are priced against. If the ERIC data underpinning the specification is incomplete or inaccurate, the framework pricing built on that specification will be unreliable regardless of how well the framework evaluation model works.

An FM supplier qualified to maintain a government office is not qualified to maintain a medical gas pipeline system. The framework that appointed them does not know the difference. The patient environment depends on someone knowing the difference.

Why generic frameworks fail in healthcare

A CCS FM framework designed for government office estates does not include HTM compliance in its specification. A supplier appointed to that framework on the basis of office FM capability may not hold the competencies, accreditations, or workforce qualifications required for NHS estate maintenance.

If a buyer uses a generic framework to procure FM for a hospital estate, the gap between what the framework specifies and what the clinical environment requires becomes a compliance risk that the framework body did not design for and the supplier did not price for.

Education estates: safeguarding, access, and fragmentation

FM procurement for schools and colleges operates under constraints that no other public sector faces. Safeguarding is the overriding concern. Every FM operative working in a school must hold an enhanced DBS check.

The school’s safeguarding policy governs how contractors access the site, where they can work unsupervised, and what training they must complete before entering the premises. These requirements are non negotiable and they add cost, complexity, and time to every FM contract.

Access constraints

Schools operate on term time schedules. Major maintenance and deep cleaning can only be carried out during school holidays. This compresses the available working window for planned preventive maintenance, reactive works backlog clearance, and capital projects into 13 weeks per year.

An FM supplier pricing a school contract from a standard availability model will underestimate the labour requirement because the work must be concentrated into holiday periods at higher cost than year round delivery. A framework rate card based on standard working patterns does not accommodate this.

The fragmentation problem

The education estate is fragmented across maintained schools (procured by local authorities), academies (procured by multi academy trusts), free schools, and further education colleges. Each has different procurement rules, different governance structures, and different funding mechanisms.

A multi academy trust with 30 schools may procure FM centrally. A maintained school may rely on the local authority’s framework. A free school may procure independently. The framework model that works for a MAT with central procurement does not work for a standalone maintained school with no procurement capability. No single framework covers the education estate adequately because the education estate is not a single market.

Blue Light estates: security, continuity, and operational sensitivity

Police, fire, and ambulance estates present a specific set of FM procurement challenges that generic frameworks do not address. Security clearance is the most obvious: FM operatives working in police custody suites, evidence storage areas, or intelligence facilities require vetting levels that most FM workforces do not hold.

The cost of vetting, the time required to process clearances, and the workforce retention challenge in a cleared FM population are all factors that generic framework pricing does not account for.

Operational continuity

Blue Light estates cannot close. A custody suite requires heating, ventilation, water, and electrical services 24 hours a day, 365 days a year. A fire station cannot schedule planned maintenance during operational hours if it compromises appliance response.

An ambulance station requires guaranteed power supply to maintain vehicle charging and medical equipment readiness. The FM contract must accommodate these operational constraints in ways that a framework specification designed for a nine to five office estate does not.

Procurement routes

Blue Light FM procurement operates through a mix of CCS frameworks, regional frameworks (particularly YPO and Kent Commercial Services), and direct tenders. The fragmentation mirrors the Blue Light organisational structure: 43 police forces, 44 fire and rescue services, and 10 ambulance trusts in England, each with its own governance and procurement approach.

Attempts to create shared Blue Light estates strategies have had mixed results. The FM supplier that wins a police FM contract in one force area has no guarantee of relevance in the neighbouring force area. The framework model assumes a degree of standardisation across the buyer base that Blue Light procurement does not deliver.

Local government: political accountability and mixed estates

Local authority FM procurement operates under a unique combination of commercial, political, and public accountability pressures. Council FM contracts are subject to member scrutiny, public transparency requirements, and political cycles that national government estates are not.

A councillor’s question about the condition of a leisure centre or the cleanliness of a housing estate carries political weight that affects procurement decisions in ways that frameworks are not designed to accommodate.

Mixed estate complexity

A local authority’s FM requirement may span corporate offices, leisure centres, libraries, housing estates, parks, cemeteries, car parks, and public conveniences. Each asset type has different compliance requirements, different service standards, and different user expectations.

A framework lot designed for corporate office FM does not cover the maintenance of a swimming pool plant room, the grounds maintenance of a public park, or the cleaning of a homeless shelter. The diversity of the local authority estate exceeds the scope of any single framework lot.

The insourcing trend

Local authorities are increasingly insourcing FM services, bringing them back in house after a period of outsourcing through frameworks. The motivations are varied: cost control, political alignment with public service values, dissatisfaction with outsourced service quality, and the desire to retain employment within the council workforce.

The insourcing trend is a direct response to the limitations of the framework model: if the framework does not deliver the quality, cost, or accountability the council requires, bringing the service in house removes the framework from the equation entirely.

The Sector Knowledge Gap

Generic framework bodies do not have sector specific expertise. CCS procurement teams are procurement professionals, not healthcare estates specialists or education safeguarding experts. They design frameworks based on procurement best practice, not sector specific operational knowledge.

The framework specification reflects what a procurement team knows how to evaluate, not what a clinical estate, a school, or a custody suite needs to operate safely.

NHS SBS exists precisely to address this gap in healthcare. But there is no equivalent for education, no equivalent for Blue Light, and no equivalent for the diverse local authority estate. These sectors are served by generic frameworks that treat FM as a single category regardless of the operating environment. The result is that sector specific knowledge, the knowledge that determines whether a contract succeeds or fails, sits with the supplier and the buyer, not with the framework.

One framework does not fit all

The four sectors examined in this article, NHS, education, Blue Light, and local government, each have compliance requirements, operational constraints, and procurement structures that generic FM frameworks cannot adequately address. A framework that works for one sector may produce contractual failure in another. The framework model assumes that FM is a single category. The operating environment proves it is not.
